			<content:encoded><![CDATA[<p><strong>Missoula First-Time Home Buyer &amp; Move- Up Home Buyer Tax Credit</strong></p>
<h3>New Legislation</h3>
<p>New legislation, the Worker, Homeownership and Business Assistance Act of 2009, which was signed into law on Nov. 6, 2009, extends and expands the first-time homebuyer credit allowed by previous Acts. The new law:</p>
<ul>
<li>Extends deadlines for purchasing and closing on a home.</li>
<li>Authorizes the credit for long-time homeowners buying a replacement principal residence.</li>
<li>Raises the income limitations for homeowners claiming the credit.</li>
</ul>
<p>Under the new law,<a id="OLE_LINK9" name="OLE_LINK9">an eligible taxpayer must buy, or enter into a binding contract to buy, a principal residence on or before April 30, 2010 and close on the home by June 30, 2010.</a> For qualifying purchases in 2010, taxpayers have the option of claiming the credit on either their 2009 or 2010 return.</p>
<p>For the first time, long-time homeowners who buy a replacement principal residence may also claim a homebuyer credit of up to $6,500 (up to $3,250 for a married individual filing separately). They must have lived  in the same principal residence for any five-consecutive year period during the eight-year period that ended on the date the replacement home is purchased.</p>
<p>People with higher incomes can now qualify for the credit. The new law raises the income limits for homes purchased after Nov. 6, 2009. The credit phases out for individual taxpayers with modified adjusted gross income (MAGI) between $125,000 and $145,000 or between $225,000 and $245,000 for joint filers. The existing MAGI phase-outs of $75,000 to $95,000 or $150,000 to $170,000 for joint filers still apply to purchases on or before Nov. 6, 2009.</p>
<h3>General Information</h3>
<p>Homebuyers who purchased a home in 2008, 2009 or 2010 may be able to take advantage of the first-time homebuyer credit. The credit:</p>
<ul>
<li>Applies only to homes used as a taxpayer’s principal residence.</li>
<li>
<div>Reduces a taxpayer’s tax bill or increases his or her refund, dollar for dollar.</div>
</li>
<li>
<div>Is fully refundable, meaning the credit will be paid out to eligible taxpayers, even if they owe no tax or the credit is more than the tax owed.</div>
</li>
</ul>
<p>The credit is claimed using <a href="http://www.irs.gov/pub/irs-pdf/f5405.pdf">Form 5405</a>, which you file with your original or amended tax return.</p>

<td colspan="6">Borrower must be employed full-time as either a police officer, firefighter, teacher/faculty (PreK-12), or emergency medical technician. Earnest money is now required and due at time of contract signing and is 1% of HUD&#8217;s listed price. This must be in the form of a cashier&#8217;s check payable to the U.S. Dept. of HUD. All participants must be employed full-time by a federal, state, county, or municipal government; Indian tribal government or division of local government. Borrowers must be in good standing with their employers. Current homeowners cannot participate and applicants cannot have owned any other residential real estate for one year prior to bid submission. Applicants must agree to live in the GNND home as their only residence for three years after they move into it. Participants must certify their intention to continue their current occupation for one year. HUD reserves the right to change eligibility requirements. Law Enforcement Officers: You must be sworn to uphold and make arrests for violations of federal, state, county, or municipal law. Your employer must certify that you are a full-time officer with unlimited general powers of arrest. Law enforcement officers are restricted to the boundaries of their authority to make arrest. Municipal, county, and state agencies usually have power of arrest throughout the entire state. Therefore, they are allowed to enter any property in the state. Federal law enforcement officers are the only area UNRESTRICTED participants in the GNND program. Federal Bureau of Prisons personnel are no longer eligible. Teachers: You must be state certified and employed by a public or private school grades preK-12. Teachers are restricted to homes that are located in the area or school district serviced by their employer. Firefighters &amp; EMTs: You are restricted to homes that are located in the area serviced by your employer. Applicants must be employed full-time and be in good standing with their employers. The Timely Payment Rewards feature rewards qualifying borrowers with an interest rate reduction of up to one percent after making timely mortgage payments for a consecutive 24-month period within the first four years, thus qualifying them for a one-time interest rate reduction. However, if your credit is good, you may qualify up-front for a lower interest rate. Maximum financed amount is $417,700 for a single-family residence or $533,850 for a 2-family residence.</p>
